A general power of attorney (GPA) is a powerful document that allows someone else to act on your behalf and look after your financial affairs.

Usually a GPA is used for a specified period of time or is revoked by the donor.  It is generally used by people who will be out of the country for a period of time to allow someone to manage their financial affairs whilst they are away.

It gives broadly similar powers to the enduring power of attorney.

Is a general power of attorney suitable for care fees planning?

Not normally.  Many people are tempted to use a GPA because it is cheap and simple to set up, particularly since the more complex lasting power of attorney was introduced.  However, there are two key reasons why this is not recommended:

1. The powers under the GPA would cease if you lost mental capacity leaving you with no-one to manage your affairs.  The deputy appointed by the court of protection may not be the person you would have selected.

2. The Lasting Power of Attorney was introduced to give you more robust legal protection and your attorneys a clearer framework in which to work.  It allows you to be more specific with the powers you give and the restrictions you impose, giving you greater control.

I work at a care provider and we are concerned and worried by this report. There are so many questions that need answering before this goes ahead and it is really difficult to plan for the future of our business.
